Are You an Employee?

In Maryland, the employment relationship exists if the employer controls the method and manner of the employee's performance. While Maryland law recognizes other factors, "control" is the one that generally distinguishes between identifying an independent contractor and an employee. A contractual provision that a person is an independent contractor and not an employee does not alone determine the relationship.
