Driving under the Influence of Drugs or Alcohol

Under Maryland law, you may lose your license and be sent to jail if you:

  1. operated a motor vehicle
  2. on a public road
  3. while affected by alcohol or drugs.

Do not be fooled: while many people plead guilty and do not go to jail, these charges are serious. The results can be devastating.

How the Law Works

  • First, the law requires the operation of the vehicle. You can be parked and be guilty of drunk driving.
  • Second, in Maryland, you can be driving in a parking lot and still be considered on a public road.
  • Third, Maryland law refers to a person being intoxicated, impaired, and under the influence. All of these levels of conduct denote guilt and result in punishment.

In criminal cases, the prosecution must show that you committed the illegal act and that you intended to perform the act. In drunk driving cases, your intent is only relevant if you were affected by a legal drug that you were unaware would impair your ability to drive.
