Rights of the Disabled in the Workplace

Some people become disabled as a result of their work. Some people have disabilities and are treated irrationally in their work. Maryland law protects people in both situations.

In the first category is the example of a woman who worked in a laboratory located in the basement. The ventilation was substandard. When a co-worker accidentally spilled a chemical, the fumes caused the woman to suffer a condition that required her to work away from toxic chemicals. The employer was required to pay for medical treatment and re-training, as well as compensate her for her lost salary.

In the other category, employers can not discriminate against qualified persons solely because of their disability. Employers also must provide reasonable accommodations. What is reasonable depends upon the circumstances of each situation.
