Bureaucratic Intrusions

Constitutional violation rarely result from roves of lawless thugs with badges. The days of the KKK in the South and the corrupt sheriffs in the Old West have passed.Today, even the most well-intentioned government officials can, in their misdirected zeal, create harships that the Constitution prohibits.

Through the powers bestowed upon their agencies, officials cause harm through regulation and enforcement. Utilizing these powers, officials can violate a citizen's

  • First Amendment rights by restricting a business's free speech
  • Fourth Amendment rights by unwarranted intrusions on a business's daily operations
  • Fifth Amendment rights by imposing overly restrictive laws that destroy a legitimate business

None of these examples even suggest an intent to harm. The Constitution protects even when the harm results from official arrogance or ignorance.

Protecting Your Rights

A legitimate day care provider expressed concerns to a customer about the condition of the customer's child. The customer, fearing that the provider was planning to report the customer to the local social service agency, made a false allegation to the agency about the provider. Agency officials then began a campaign of constant inspections and investigations. Customers became anxious and, as could be expected, removed their children.

Although the agency eventually came to learn the truth, the damage had been done. There had been no hearing; no charges; and no evidence. The agency's harassment cost the provider all of her customers. While we can appreciate the concerns of the agency, the Constitution protects us from the officials' failure to consider the rights - and innocence - of the day care provider.
